Ofcom Update: Ofcom invites applications for community radio licences

Ofcom today invites applications for licences to provide community radio services within east and southeast England, excluding Greater London and other areas within the M25.  The closing date for receipt of completed applications is 5.00 pm on Tuesday 18 November 2008.
 
Ofcom will be hosting presentations on the licensing process in September. Applicants interested in attending should contact community.radio@ofcom.org.uk

Ofcom Update: Ofcom fines Satellite Entertainment Ltd for Broadcasting Code breaches

Ofcom has fined Satellite Entertainment Ltd £20,000 for breaches of Ofcom's Broadcasting Code in respect of its service SportsxxxBabes. SportsxxxBabes broadcasts free-to-air 'adult chat' programming. Satellite Entertainment Ltd was fined because SportxxxBabes transmitted free-to-air explicit sexual content, which Ofcom considered to be 'adult-sex' material.
 
Specifically, Ofcom has found Satellite Entertainment Ltd in breach of the following rules:
 
Rule 1.24: "Premium subscription services and pay per view/night services may broadcast 'adult-sex' material between 2200 and 0530 provided that in addition to other protections:

•there is a mandatory PIN protected encryption system, or other equivalent protection, that seeks satisfactorily to restrict access solely to those authorised to view; and
•there are measures in place that ensure that the subscriber is an adult";
 
Rule 2.1: "Generally accepted standards must be applied to the contents of television and radio services so as to provide adequate protection for members of the public from the inclusion in such services of harmful and/or offensive material"; and
 
Rule 2.3: "In applying generally accepted standards broadcasters must ensure that material which may cause offence is justified by the context…Appropriate information should also be broadcast where it would assist in avoiding or minimising offence".

Ofcom Update: Ofcom publishes applications for capacity on Multiplex B.

Ofcom has received two applications from the public service broadcasters eligible to apply for the capacity available on Multiplex B. The two applicants are the Channel 3 licensees collectively, and Channel 4 (jointly with S4C and Teletext).  We are now considering these applications and expect to publish our decision in September.

Ofcom Update: Participation TV Part 2 - consultation update

Ofcom’s consultation on Participation TV Part 2: keeping advertising separate from editorial closed on 3 July 2008. The consultation proposed amendments to the Ofcom Broadcasting Code to ensure that programmes based on audience participation are not effectively advertisements for premium rate services.
 
We were intending to publish a statement in summer 2008. However, we received over 50 responses from stakeholders representing a diverse range of views, which require further consideration. Ofcom anticipates making a more detailed announcement before the end of the year. As usual, should Ofcom decide to make any regulatory changes, licensees will be given reasonable notice before such changes are implemented.

Illegal broadcasting is a menace which can cause interference to safety of life communications services and legal radio stations, denying listeners their choice of service. Ofcom, together with the police and local authorities takes swift action against this illegal activity. Ofcom today published a factsheet on its work in tackling illegal broadcasting, which contains information on how to contact Ofcom to report illegal broadcasters.

Ofcom Update: Radio Licensing

Ofcom is today inviting declarations of intent to apply for the FM local commercial radio licence for Thanet.  The licence is currently held by KMFM Thanet Limited, and is due to expire in January 2010.
 
Ofcom proposes to grant a further licence for this area, for a period from the expiry date of the current licence to 31 December 2015. The closing-date for the receipt of declarations of intent from prospective licence applicants is 3.00pm on Tuesday 2 September 2008.

Ofcom is also today announcing that it has re-awarded the local FM commercial radio licences for the Wolverhampton and Southport areas to the current licensees, Wolverhampton Area Radio Limited and Dune FM Limited respectively. These licences have been re-awarded under Ofcom's 'fast-track' process, as set out in published guidelines, and both will be for a period from their current expiry date to 31 December 2015.
 
Seperately, Ofcom has received one declaration of intent for the Eastbourne local commercial radio licence from the current licensee, Sovereign Radio Limited.  Ofcom is therefore inviting the incumbent licensee to reapply for the licence under the 'fast-track' procedure as set out in Ofcom's guidelines.

Ofcom Update: Ofcom publishes clarification on TV Advertising Code

Ofcom today published an update to its Code on the Scheduling of Television Advertising, originally published on 24 July 2008, following requests from stakeholders for further clarification.  Specifically, Ofcom has included a table in paragraph 14 of the Code which shows the number of breaks permitted in programmes of different durations on non-PSB channels.
 
As explained in the statement published on 24 July 2008, the effect of the Code is to maintain the current effective limits on the number of advertising breaks that may be taken in programmes of a given duration.
