Ofcom Update: Community radio licensing

Ofcom today announces the award of three new community radio licences.
 
 
Separately, Ofcom has updated the timetable for inviting community radio licence applications.
 
We intend to invite applications for the east and southeast of England, excluding the Greater London area, at the end of August 2008.  We will update this timetable with dates for Greater London (within the M25) in due course. 
 
 
In addition, Ofcom also announced the grant awards from the first round of funding from the Community Radio Fund 2008/09. In total £266,600 has been awarded to 18 applicants.
 
The Fund has been established to help fund the core costs of running a community radio station.

Finally, Ofcom is also publishing  guidelines for community radio stations that wish to use volunteer time as part of station turnover.

Ofcom Update: Ofcom fines radio broadcasters for unfair conduct in a listener competition

Ofcom has today fined 30 local radio stations, which form part of GCap Media's One Network, a total of £1,110,000 for the unfair conduct in a listener competition; Secret Sound.
 
Taken together, the fines amount to the highest total financial penalty to be imposed for the broadcast of radio content which has been found in breach of the Broadcasting Code.
 
The radio stations were found in breach of the following rules:
 
Rule 2.11 of the Ofcom Broadcasting Code "Competitions should be conducted fairly…"; and
Rule 10.10 of the Ofcom Broadcasting Code "Any use of premium rate numbers must comply with the Code of Practice issued by ICSTIS" (now re-named as PhonepayPlus).
 
Ofcom's investigation found that on a number of occasions programme makers deliberately put to air text entrants with incorrect answers in order to prevent the prize from being won too soon. As a result, those listeners who had paid to enter the competition on these occasions had no chance of winning.
 
The seriousness of the compliance failures was compounded by some of the actions taken by GCap after the incidents had come to light.
 
Ofcom has also directed each of the 30 licensees to broadcast a summary of Ofcom's finding on two separate occasions.

Ofcom Update: Ofcom begins assessment of the BBC's proposed Local Video service

Ofcom today published the Terms of Reference for its Market Impact Assessment (MIA) of the BBC’s proposed Local Video service. The MIA will examine the likely impact of the service proposed by the BBC on similar and related products and services, examining in particular the extent to which the service might affect innovation and investment in the commercial sector.
 
The Local Video service would expand upon existing BBC Local websites on bbc.co.uk and focus on 60 areas, typically a county or conurbation, across the UK. It would create bespoke local video news, sport and weather to complement the BBC’s existing online provision.
 
The results of the MIA will be published alongside the BBC Trust’s Public Value Assessment on 18 November 2008.

Ofcom update: Digital Dividend - geographic interleaved awards

Ofcom today published its second consultation on the spectrum that will be freed up as a result of digital switchover. Today’s consultation details proposals for the release of spectrum in the geographical ‘white spaces’ that will exist between digital television transmitters after digital switchover. This spectrum can be used for low power services including:
  • new digital television services covering most of the UK, a UK region or nation;
  • television services covering a city or a local area;
  • services in support of programme making and special events; and
  • possibly mobile television and mobile broadband

Ofcom Update: Radio licensing

Ofcom is today updating its timetable for the re-advertisement of local analogue commercial radio licences.
 
The timetable now includes details of those licences which are due to expire between May and December 2010, for which the re-advertisement process will start during 2009.  All commercial radio licences which are re-awarded under existing statutory legislation are granted for a five-year period or with an expiry date of 31 December 2015 (whichever constitutes a longer period).

Separately, Ofcom is today inviting declarations of intent to apply for the FM local commercial radio licence for Southport.  The licence is currently held by The Local Radio Company plc, broadcasting as 107.9 Dune FM, and is due to expire in October 2009.
 
Ofcom proposes to grant a further licence for this area, for a period from the expiry date of the current licence to 31 December 2015. The closing-date for the receipt of declarations of intent from prospective licence applicants is 3.00pm on Thursday 3 July 2008.

In addition, Ofcom has received one declaration of intent for the Wolverhampton local commercial radio licence from the current licensee, Wolverhampton Area Radio Limited.  Ofcom is therefore inviting the incumbent licensee to reapply for the licence under the 'fast-track' procedure as set out in Ofcom's guidelines.

Ofcom Update: Ofcom fines MTV Networks Europe for Broadcasting Code breaches

Ofcom has today fined MTV Networks Europe a total of £255,000 for widespread and persistent breaches of the Ofcom Broadcasting Code in respect of its channels TMF, MTV France, MTV UK and MTV Hits.
 
MTV Networks Europe was fined for the broadcast of highly offensive language and material (in some cases repeatedly) before the watershed. Ofcom concluded that this material was not justified by the context of broadcasts that were likely to appeal to children and that the likely audience would have expected to have been protected from the most offensive language and material in such programming.
 
Specifically, Ofcom has found TMF, MTV France, MTV UK and MTV Hits in breach of certain of the following rules:
 
Rule 1.3:  "Children must also be protected by appropriate scheduling from material that is unsuitable for them";
Rule 1.4:  "Television broadcasters must observe the watershed";
Rule 1.14:  "The most offensive language must not be broadcast before the watershed or when children are particularly likely to be listening";
Rule 2.3:  "In applying generally accepted standards broadcasters must ensure that material which may cause offence is justified by the context"; and
Condition 11 of the Licence:  "Failure to supply recordings".

Ofcom Update: Ofcom gives consent to BBC and ITV for Euro 2008 Coverage

Following a request received from ITV and BBC for consent to broadcast live coverage of part of the Euro 2008 Football Championships, Ofcom invited comments from other broadcasters and interested parties by 25 April 2008 (http://www.ofcom.org.uk/consult/condocs/euro2008/).

After considering information supplied by the BBC and ITV in support of their applications and the one (confidential) response to the public consultation, Ofcom has decided to grant consent to the proposed coverage.

ITV and the BBC will be sharing coverage of Euro 2008. All of the matches which they will be showing will be on ITV1 and BBC One except for four in the earlier stages of the tournament which clash with other matches on the same evening and which will therefore be shown on ITV or BBC digital channels.
