Ofcom Update: Regional news variations

Ofcom today published variations to the Channel 3 broadcast licences for the following regions:
 
Anglia (East of England), Border (Borders and the Isle of Man), London Weekday (London), London Weekend (London), Central (East, West and South Midlands), Granada (North-West England), Meridian (South and South-East England), Tyne Tees (North-East England), Wales and West (Wales and West of England), Westcountry (South-West England), Yorkshire (Yorkshire and Lincolnshire).
 
The licence variations reduce the minimum regional news requirement by 10 minutes a week to take account of changes in Ofcom's methodology in calculating the number of hours broadcast. These changes took effect at the beginning of 2007 following the introduction of a new data collection and reporting system and the licence variation has been back-dated to reflect this. The changes are not intended to result in any change to the volume of regional news required on screen.

Ofcom Update: Ofcom rejects Format change requests to Smooth Radio in London and the North-West

Ofcom's Radio Licensing Committee has rejected Format change requests, submitted by Guardian Media Group (GMG), regarding Smooth Radio in London (102.2FM) and the North-West (100.4FM). GMG wished to remove the obligation to broadcast 45 hours of jazz music on each station in return for providing a 24 hour jazz service on DAB in London and the North-West.
 
Ofcom welcomes GMG’s desire to provide jazz services on DAB. However, under existing legislation, Ofcom cannot link consideration of a change to analogue radio services to a proposed change to DAB services.

Ofcom Update: Ofcom publishes simplified analogue commercial radio Formats

Ofcom has today published the new simplified Formats which form part of analogue (FM and AM) commercial radio licences.  Formats have been streamlined to provide licensees with greater flexibility while continuing to secure the overall character of each station.  This follows Ofcom's Future of Radio project, which resulted in a new approach to regulating analogue commercial radio that recognises changes in the market arising from the growth of the internet and the move towards digital radio.

The Future of Radio project also resulted in new guidelines for the provision of local content on analogue commercial radio, published in February 2008. These guidelines allow stations to apply to co-locate, and share programming, with other stations.

Ofcom today published its Public Service Broadcasting Review. The review sets out alternative ways that public service broadcasting (PSB) can be funded in the future. 
 
The review covers all public service broadcasters, both publicly-owned (the BBC, Channel 4 and S4C) and commercial (ITV1, five and Teletext).

Ofcom Update: Re-advertisement of local analogue commercial radio licences

Ofcom is today making a number of announcements regarding the re-advertisement of local analogue commercial radio licences. These announcements follow Ofcom's decision to re-award any analogue commercial radio licences, which are due to expire under existing statutory legislation, for a five-year period or with an expiry date of 31 December 2015 (whichever constitutes a longer period).

Canterbury and Dover/Folkestone
Ofcom is today inviting declarations of intent to apply for the FM local commercial radio licences for the Canterbury and Dover/Folkestone areas of Kent. The licences are currently held by CTFM Limited and South East Radio Limited respectively, and both are due to expire in September 2009.
 
Ofcom proposes to grant further licences for these two areas, for a period from the expiry date of the current licences to 31 December 2015. The closing-date for the receipt of declarations of intent from prospective licence applicants is 3.00pm on 6 May 2008.

Ofcom has received one declaration of intent for the Ullapool local commercial radio licence from the current licensee, Lochbroom FM Limited. Ofcom is therefore inviting Lochbroom FM Limited to reapply for the licence under the 'fast-track' procedure as set out in Ofcom's guidelines.
 
Wigan
Ofcom is also today announcing that it has re-awarded the local FM commercial radio licence for the Wigan area to the current licensee, 102.4 Wish FM Limited. This licence has been re-awarded under Ofcom's 'fast-track' process, as set out in published guidelines, and will be for a period from 1 April 2009 to 31 December

Ofcom Update: Adjudication on Live Earth, broadcast on BBC1 and BBC2

Ofcom today published its Adjudication on Live Earth broadcast on BBC1 and BBC2 on 7 July 2007. 22 viewers complained that the BBC broadcast unacceptable language before the watershed during this live music event programme.
 
Ofcom's investigation concluded that the broadcast of the most offensive language before the  9 pm watershed was in breach of its Broadcasting Code in respect of:
 
Rule 1.14 - "The most offensive language must not be broadcast before the watershed...."; and
 
Rule 2.3 - "In applying generally acceptable standards broadcasters must ensure that material which may cause offence is justified by the context".
 
In light of the serious and repeated nature of these breaches, Ofcom's Content Sanctions Committee concluded that it was appropriate and proportionate to direct the BBC to broadcast a summary of Ofcom’s findings on BBC1 and BBC2.

Ofcom Update: Ofcom tightens regulation of Participation TV

New rules to tighten the regulation of television and radio programmes that rely heavily on premium rate telephone services (PRS) – typically quiz shows, psychic and adult chat – were proposed today by Ofcom. 
 
The proposed new Broadcasting Code rules will ensure that programmes that invite viewers and listeners to interact or participate are not vehicles for promoting commercial, revenue-generating services.  In addition, the rules will ensure that viewers are adequately protected and that advertising is kept separate from editorial content, as required under European legislation

Ofcom Update: ITV and BBC request Ofcom consent for Euro 2008 Broadcasts

ITV and BBC have applied for Ofcom consent to broadcast live coverage of the Euro 2008 Football Championships.
 
Ofcom is now inviting broadcasters, and any other interested parties, to comment on  the  ITV and BBC request by  Friday 25 April 2008.

Ofcom update: Ofcom publishes consultation on UTV's request to co-locate Imagine FM

Ofcom is today consulting on UTV’s request to co-locate Imagine FM (Stockport) with its stations in Warrington (102.4 Wish FM, 107.2 Wire FM and Tower FM).  UTV is making no request to share extra programming.
 
In this case, Ofcom considers that this request would substantially alter the character of the service provided by Imagine FM because the area covered by the station has an adult population of more than 250,000 adults.
 
Respondents have until 5pm on 1 May 2008 to reply to Ofcom’s consultation.

Ofcom update: Ofcom publishes its Annual Plan for 2008/9

Ofcom today published its Annual Plan which sets out its work programme for the financial year April 2008 to March 2009.

Ofcom Update: Ofcom statement on upgrading DTT
