Ofcom Update: Listed events and Channel 5

Ofcom today confirmed that Five has been given listed event status, the same as BBC1, BBC2, ITV1 and Channel 4 .  This means that it is now in the category of free television channels which must be given a genuine opportunity to bid for the right to broadcast listed sports events such as  the highlights of Cricket Test Matches played in England. 
 
Ofcom is satisfied that Five has met the two qualifying conditions, which are :
  • the service is provided "free" at reception.
  • the service is received by at least 95% of the  UK population.

Ofcom Update: Ofcom publishes its submission to the Byron Review

Ofcom has today published its submission to the Byron Review.
 
In September 2007 the Government announced an independent review of the risks to children from exposure to potentially harmful or inappropriate material on the internet and in video games.  Dr Byron has today published her report with its recommendations.
 
As part of its work to promote media literacy in the UK, Ofcom encourages people to make informed choices about their internet use and particularly to learn how to manage any risks they are potentially exposed to when online.   Ofcom therefore has an interest in the protection of consumers, and in particular children, from harm when online and consequently submitted evidence to the Review.

Ofcom Update: Ofcom publishes fact sheets relating to digital switchover

Ofcom has today published three fact sheets relating to the UK's switch to digital television.
 
The fact sheets provide detailed information on digital terrestrial television coverage, as follows:
 
- Fact sheet 1: Digital terrestrial television coverage predictions.  To assist the process of planning for switchover, computer models are used to predict coverage of the digital terrestrial television (Freeview) signal.  This fact sheet explains how the predictions are worked out.
 
- Fact sheet 2: Coverage of the public service multiplexes after switchover.  The coverage of the public service multiplexes has been designed to meet the same coverage level (98.5% of the population) as the existing analogue services after switchover.  However, these multiplexes will not cover exactly the same 98.5% of households. This fact sheet sets out the reasons for the differences along with details on the ways in which different groups of households might be affected.
 
- Fact sheet 3: Why some people will receive more digital television channels than others.  There are four different ways to get digital television: through an aerial (Freeview), by satellite, cable or broadband. This fact sheet sets out the different digital television options and explains why the number of television channels available on Freeview differs in different parts of the UK.

Ofcom update: Senior appointments in Ofcom

Ofcom has appointed Jonathan Thompson, currently Channel Four’s Director of Strategy and Research, as its new Director of Strategy. The regulator has also appointed Campbell Cowie, at present Time Warner (Europe) Executive Director of Public Policy, to be a Policy Director in the Strategy and Market Developments team.
 
Mr Thompson, who will take up the position in  June, has been closely involved in the recent “Next on 4” vision statement from Channel 4.   Having joined Channel 4 in 1998, he has been responsible for leading corporate strategy across the entire organisation - including the main channel, digital channels and Channel 4’s new media activities – and for all audience research across programming, marketing and advertising sales. He was previously at media sector consultants Hydra Associates.
 
Mr Cowie has been at Time Warner since 2002 where he directed economic regulatory and competition policy matters for the company and provided strategic, economic and policy advice at Board level within its European businesses. He was Head of Fair Trading and Regulation at the BBC from 1999-2002 having taught economics and media at City University previously. He will begin at Ofcom in June.

Ofcom Update: Proposals to simplify rules on distribution of TV advertising

Ofcom today published proposals to simplify the rules around the distribution of television advertising.  These include rules about the intervals between advertising breaks, and restrictions on breaks in certain programmes. 
 
The proposals, which cover all commercial broadcasters, would allow broadcasters to schedule advertising breaks at more appropriate times during programmes.

Ofcom Update: Annual statements of programme policy by commercial public service broadcasters and Ofcom's response

The commercial public service broadcasters are each required under the Communications Act 2003 to publish annual statements setting out their policy in relation to public service content for the coming year, and reviewing the past year's performance.
 
The commercial public service broadcasters (ITV1, GMTV, Channel 4, Five, and Teletext) have today published their statements of programme policy for 2008 and reviews of 2007.
 
As part of the process of preparing its statement, ITV consulted Ofcom about its intention to reduce its children's programming further in 2008.  Ofcom's views on this are set out in a regulatory statement available from the link below.

Ofcom Update: Ofcom publishes 2007 Review of ITV Networking Arrangements

Ofcom today publishes  its statement  to conclude the 2007 Review of the ITV Networking Arrangements. 
 
The ITV Networking Arrangements are a set of arrangements between ITV Network Ltd and the 15 regional Channel 3 licensees. They are designed to co-ordinate the provision of a national television service capable of competing effectively with other broadcasters in the UK.
 
Ofcom has a statutory duty under section 293 of the Communications Act 2003 to carry out an annual review of the Networking Arrangements. After taking into account various developments in the course of 2007 the statement concludes that there is no need for any immediate changes to the current Networking Arrangements but does anticipate that there may need to be a fuller review in 2008.

OFCOM CORRECTION: Requested Format changes to 102.2 and 100.4 Smooth Radio

Please note the Ofcom notification issued earlier today contains an
error in the second paragraph. This should read:

GMG states that if Ofcom approves the change request detailed above it
will provide a 24 hour a day jazz service on DAB in London and the
North-west.

Smooth Radio


Ofcom today published a consultation on requested Format changes to
102.2 Smooth Radio (Greater London) and 100.4 Smooth Radio (North-West
England). The station owners, Guardian Media Group (GMG), are seeking to
remove the requirement on these stations (broadcasting on both FM and on
DAB in their respective regions) to provide 45 hours of jazz programmes
a week. In addition, GMG wishes to remove the obligation in the North
West to play "jazz, soul, blues and R & B".

GMG states that if Ofcom approves the change request detailed above it
will provide a 24 hour a day jazz service on DAB in London only.

Legislation requires Ofcom to consider the requested changes to Smooth
Radio in London and the North West on a stand-alone basis and so this
consultation relates solely to those two FM stations. Consideration of
these changes cannot be linked to any possible future request from GMG
to launch a jazz station on DAB.

Ofcom believes this change would significantly alter the station's
Format and is seeking stakeholders' views on the proposals. The closing
date for responses is 11 April 2008.

Ofcom Update: Requested Format changes to 102.2 and 100.4 Smooth Radio

Ofcom today published a consultation on requested Format changes to 102.2 Smooth Radio (Greater London) and 100.4 Smooth Radio (North-West England). The station owners, Guardian Media Group (GMG), are seeking to remove the requirement on these stations (broadcasting on both FM and on DAB in their respective regions) to provide 45 hours of jazz programmes a week. In addition, GMG wishes to remove the obligation in the North West to play "jazz, soul, blues and R & B".
 
GMG states that if Ofcom approves the change request detailed above it will provide a 24 hour a day jazz service on DAB in London only.
 
Legislation requires Ofcom to consider the requested changes to Smooth Radio in London and the North West on a stand-alone basis and so this consultation relates solely to those two FM stations. Consideration of these changes cannot be linked to any possible future request from GMG to launch a jazz station on DAB.
 
Ofcom believes this change would significantly alter the station’s Format and is seeking stakeholders’ views on the proposals. The closing date for responses is 11 April 2008.

Separately, Ofcom is today announcing that it has re-awarded the local FM commercial radio licence for the Kingston-upon-Thames area to the current licensee; Radio Jackie Limited. This licence has been re-awarded under Ofcom's 'fast-track' process, as set out in published guidelines, and will be for a period from 1 March 2009 to 31 December 2015.
 
This announcement follows Ofcom's decision to re-award any analogue commercial radio licences which are due to expire under existing statutory legislation for a five-year period or with an expiry date of 31 December 2015 (whichever constitutes a longer period).

Ofcom Update: 100 Community Radio stations now on air

Community radio, not-for-profit stations that deliver specific social benefits to local communities, today passed a significant milestone, with the 100th station in the UK going on-air.
 
Community radio stations typically cover small geographical areas with a coverage radius of up to 5km and are run on a not-for-profit basis. They focus on the delivery of specific social benefits to particular geographical areas or community interests.

Ofcom Update: Pre-advertisement of local analogue commercial radio licence for Ullapool

Ofcom is today inviting declarations of intent to apply for the FM local commercial radio licence for the Ullapool area in Scotland, currently held by Lochbroom FM Limited. The current licence will expire in May 2009.
 
Ofcom proposes to grant a further licence for this area, for a period from 23 May 2009 to 31 December 2015. The closing-date for the receipt of declarations of intent from prospective licence applicants is 3.00pm on Monday 14 April 2008.

Ofcom Update: TV Transmitter Location Maps

Ofcom has today published updated maps showing the locations of the television transmitters which will be converted to digital operation during the digital switchover process. Maps for the London, Central, and Meridian regions will be re-published in due course.
 
The maps will be further revised from time to time as technical planning for digital switchover progresses, and stakeholders are advised to check the link below for the most up-to-date versions.

Ofcom announces today that Non-Executive Director Stephanie Liston is to step down from the Board from March 31 2008.

A senior lawyer with international commercial and regulatory experience, Stephanie Liston joined the Ofcom Board in 2005; she is stepping down to pursue a range of business interests across the communications sector.

Ofcom Chairman David Currie said “On behalf of the Board I would like to express Ofcom’s gratitude to Stephanie Liston for all her hard work and dedication to Ofcom since her appointment. Her expertise has been of substantial assistance to Ofcom as we have sought to regulate in the interests of citizens and consumers across the range of our duties."
