Ofcom today published a revised outline procedure for imposing statutory sanctions on broadcasters for breaches of any content or content-related requirements, including breaches of the Broadcasting Code.
Following full public consultation, Ofcom will make the following changes:
- Streamlining the process by reducing the number of stages in the procedures;
- Introduction of a fast-track procedure for use in certain cases, for example: in cases where Ofcom considers it in the public interest or if there is ongoing risk of material harm, including financial loss, to viewers or listeners;
- Clarification of the procedure for issuing directions or revoking licences in order to bring greater transparency for broadcasters.
The revised outline procedure is effective immediately and will apply to all cases subsequently considered for a sanction. Where sanctions procedures are already underway, the broadcaster may request that the revised outline procedure is used from now onwards.
