Ofcom Update: Ofcom fines Channel Four for misconduct in viewer competitions

Ofcom has today fined Channel Four Television Corporation a total of £1.5 million for misconduct in viewer competitions in the Richard and Judy (You Say We Pay competition) and Deal or no Deal programmes.
 
Channel Four was found in breach of the following rules:
 
Rule 2.11 of the Ofcom Broadcasting Code, which came into effect on 25 July 2005,  "Competitions should be conducted fairly…";
Rule 10.10 of the Ofcom Broadcasting Code "Any use of premium rate numbers must comply with the Code of Practice issued by ICSTIS" (now re-named as PhonepayPlus); and
Rule 8.2(b) of the ITC (Independent Television Commission) Code 2002 "Use of Premium Rate Telephone Services in Programmes: The licensee must retain control of and responsibility for the service arrangements....".
 
In particular, Ofcom's investigations found Channel Four in breach of the Code for the following types of misconduct:
 
Early selection - picking competition finalists before lines had closed in the Richard & Judy 'You Say We Pay' competition. This meant that viewers, calling to enter competitions after the shortlist had been compiled, stood no chance of becoming a finalist as the early selection had already taken place.
 
Staggered selection - operating a staggered selection for selecting finalists in both the Richard & Judy 'You Say We Pay' and the Deal or no Deal competitions. Ofcom found this selection process created unfair odds which meant that viewers entering the competition were not given a fair and equal  chance of winning. In particular, later entrants had a lower statistical probability of being shortlisted as a potential winner, compared to those who entered earlier.
 
Ofcom has also directed Channel Four to broadcast a summary of both Ofcom's findings into Richard and Judy (You Say We Pay competition) and Deal or no Deal programmes on three separate occasions.

Ofcom Update: Radio licensing

Ofcom today advertises a new local Digital Audio Broadcasting (DAB) radio multiplex licence to cover Surrey and Northern Sussex.
 
Today's advertisement is one of a number of new local radio multiplex licences planned to develop DAB coverage for local services in those parts of the country not already served.

Separately, Ofcom is today starting a programme of re-advertising FM local analogue  commercial radio licences which are due to expire from 2009 onwards. All commercial radio licences which are re-awarded under existing statutory legislation will be granted for a five-year period or with an expiry date of 31 December 2015 (whichever constitutes a longer period).
 
The first FM local analogue commercial radio licence due to expire is  the one for the Kingston-Upon-Thames  area in February 2009, currently held by Radio Jackie. Ofcom  is today inviting declarations of intent to apply for the licence.

Ofcom Update: Ofcom interim data on the impact of restrictions on food and drink advertising to children

In February 2007, Ofcom published its final statement on the Television Advertising of Food and Drink to Children which launched a package of new rules aimed at reducing the impact of advertising of high fat, salt and sugar (HFSS) food and drink to children. On 12 December 2007, Ofcom briefed a group of consumer, health and industry representatives on the first six months of data on the impact of these phased restrictions.
 
Since 1 April 2007, HFSS advertisements have not been permitted in or around programmes on the main channels made for children, or in or around programmes that are likely to be of particular appeal to children aged 4-9. On 1 July 2007 a set of revised, tighter content rules relating to HFSS food and drink advertising came fully into effect. Further restrictions will come into effect in 2008 (see below).
 
When launching the rules, Ofcom committed to a full review during 2008 of how well the new advertising restrictions are working. In conducting the review, we will work with the Department of Health, which is collecting data about advertising across all media, and with the Food Standards Agency which will be reviewing the operation of the nutrient profile model used in the rules.
 
Interim data – emerging trends
 
Whilst it is still too early to come to any firm conclusions about the success or otherwise of the new rules, there are clear signs that the new rules are having the intended effect on reducing the amount of food and drink advertising that children are exposed to on television.
 
The interim data reflects the partial introduction of the restrictions to date:
 
• The amount of HFSS advertising that children see has declined in line with Ofcom’s predicted forecasts.
• Television share of total core category advertising spend has fallen from 68% to 64% since 2005.
• The greatest decline in impacts has been in relation to children aged 4-9 years (down 27% since 2005) and down 57% in children’s airtime.
• Core category 4-15 year olds impacts on television fell by 20% between April and September 2005 and the corresponding period in 2007. This was driven by a 59% decline in impacts delivered during children’s airtime, most of which (53%) has taken place between 2006 and 2007, since the rules were introduced.
• Core category advertising on terrestrial children’s programming has fallen to negligible levels, and is declining markedly on dedicated children’s channels.  The decline on dedicated children’s channels has been greater than the reduction required under Ofcom’s phased rules.
• Impacts on dedicated children’s channels fell by 49% from 2005 to 2007.
• Within that overall reduction, there has been an increase in 4-15 core category impacts in “adult” non-terrestrial airtime (up 26% since 2005), leading to an overall 2% increase in impacts delivered across all adult airtime.  This reflects increased viewing of non-terrestrial ‘adult’ targeted channels by children.
 
Restrictions yet to take effect
 
On 1 January 2008, the scheduling restrictions relating to programmes of particular appeal to children will be extended to cover the ages 4-15 years. Children’s channels have been allowed a graduated phase-in period, with full implementation of the restrictions required from 1 January 2009.
 
Explanatory notes
 
The data is taken from the Nielsen Media database. It is important to note that these interim results are based on all food and drink advertising of core category products, which means all food and drink advertising including total food, total soft drinks, total beverages (excluding alcoholic drinks) and chain restaurants. Therefore, the research does not distinguish between advertising of HFSS and non-HFSS products, nor does it distinguish between core category advertising for products of particular appeal to children and core category products which appeal to a general audience such as adult drinks, cheese or luxury chocolates.
 
Next steps
 
When launching these new rules in February, Ofcom committed to a full review during 2008 of how the new advertising restrictions are working and will publish further data when that review is completed.

Ofcom Update: Pay TV joint submission and Sky's response

Ofcom today published the non-confidential version of the Pay TV joint submission by British Telecommunications plc, Setanta Sport Holdings Ltd, Top Up TV Europe Ltd, Virgin Media Ltd and the response by British Sky Broadcasting Group plc. 

Ofcom received the four parties’ preliminary submission in January 2007. This subsequent version was received in July 2007, and Sky submitted its response in November 2007. 

In March this year Ofcom announced that, following the preliminary joint submission, it would undertake a market investigation of the pay TV market.  Ofcom intends to publish a Consultation document as part of this investigation shortly.

Ofcom Update: Ofcom introduces new arrangements for signing on television

Following Ofcom’s television access services review last year, Ofcom consulted separately with deaf groups and broadcasters about arrangements for signing on television.  Ofcom found that on low audience channels, sign language users want to see more programmes presented in sign language in place of programmes made for hearing people with a signer superimposed.

 

As a result of the consultation, Ofcom has decided to exclude channels with an audience share of less than 1% from meeting signing targets set out in the Television Access Services Code. Instead these licensees will be required either:

 

o       to broadcast 30 minutes of sign-presented programming at least once a month between 7am and 11pm; or

o      to enter into a voluntary arrangement, approved by Ofcom, which will help to deliver more sign-presented programming.

 

Current arrangements for signing on public service channels and on channels with more than 1% audience share will remain, both to ensure that analogue-only viewers continue to have access to signing on television, and to maintain a variety of signed programmes for all sign language users.
