Ofcom Update: Ofcom publishes Radio Update for November

Ofcom has today published its Radio Update for November. The update includes a Content Sampling Report on Ocean FM (South Hampshire), to whom a Yellow Card has been issued for breach of Format.

Ofcom Update: Ofcom fines Connection Makers Ltd for breaches of its Broadcasting Code

Ofcom has today fined Connection Makers Ltd  ("Connection Makers") £25,000 for breaches of Ofcom's Broadcasting Code ("the Code") in respect of its service Babeworld TV.  
 
Connections Makers has been fined for transmitting explicit sexual content, which Ofcom considered to be 'adult-sex' material, on a free-to-air channel just after the watershed. The broadcast was found in breach of Ofcom's rules, set out in the Code, which are aimed at protecting under 18s and adults from offensive material.
 
In addition, Ofcom found the licensee in further breach of the Code by promoting a Premium Rate Service ( "PRS" )  inviting viewers to contact 'off-screen' girls. The Code only permits broadcasters to promote a PRS if it forms part of the editorial content of the programme or is programme-related material. In this case Connection Makers was not allowed to promote the PRS.

Ofcom update: Ofcom and BBC Trust hold seminar to agree measures to build public confidence in broadcasting

Ofcom and the BBC Trust jointly hosted a seminar on Monday 26 November on the issue of trust in broadcasting. The seminar was held following an agreement by industry leaders in September to meet and discuss collective steps that could be taken to rebuild public trust in broadcasting following recent editorial and compliance failures.

Ofcom Update: Ofcom has today advertised a local FM commercial radio licence

Ofcom today advertises a local FM commercial radio licence to cover Plymouth. This is the second time Ofcom has advertised this licence.
 
Ofcom had originally awarded this licence to Radio UK Holdings Limited, owned by Macquarie Bank Limited, in March 2006. However, Macquarie has now decided not to take up the licence.

Ofcom Update: Re-advertisement of local analogue commercial radio licences

Ofcom is today publishing guidelines and a timetable for the re-advertisement of local analogue commercial radio licences. This follows Ofcom's Future of Radio statement, published last week.
 
Ofcom has decided that all commercial radio licences which are re-awarded under existing statutory legislation will be granted for a five-year period or with an expiry date of 31 December 2015 (whichever constitutes a longer period).

Ofcom Update: Ofcom advertises new local digital radio multiplex licence

Ofcom today advertises a new local Digital Audio Broadcasting (DAB) radio multiplex licence to cover Mid and West Wales.


Today's advertisement is one of a number of new local radio multiplex licences planned to develop DAB coverage for local services in those parts of the country not already served.

Ofcom update: Mystery shopping research into the sale of HD Ready televisions

Ofcom today published the results of a mystery shopping survey into the sale of HD Ready television sets by retailers. The research finds that the information provided to shoppers about HD Ready television sets was accurate in the majority of cases. However, the research also found that there was significant confusion amongst some retail staff over the current and future availability of high definition television services on Freeview.

Ofcom Update: Ofcom sets out radio sector reform

Ofcom today published its statement on future regulation of the commercial and community radio sectors. Ofcom’s approach simplifies regulation for the commercial radio sector, whilst safeguarding the interests of listeners.

In particular, Ofcom's statement sets out that:
  • all FM stations should provide at least 10 hours of locally-made programmes each weekday (including breakfast) and a minimum of four hours at a weekend.
  • smaller stations may be able to share a large proportion of this programming (outside breakfast) with other nearby stations;
Ofcom’s revised proposals on local programming are subject to a further Consultation, which closes on 21 December 2007.
 
Furthermore, Ofcom welcomes today’s announcement made by the Department for Culture Media and Sport to set up a Digital Radio Working Group. Ofcom will play a major role in this group which has been tasked to assess the conditions needed for digital platforms to become the predominant means of delivering radio in the UK.

Commenting on Ofcom’s finding that Channel 4 Dispatches: Undercover Mosque was not in breach of the Broadcasting Code, Ed Richards, Ofcom Chief Executive, said:
 
“Ofcom's investigation found that Dispatches had uncovered matters of clear public interest and had handled the material responsibly finding no evidence that Channel 4 had misled its audience.
 
In keeping with its remit as a public service broadcaster, it is essential that Channel 4 continues to produce challenging programmes about controversial issues which are responsibly handled.  In this case the Dispatches team did not shy away from a difficult subject and upheld British broadcasting's strong tradition of investigative journalism.”

Ofcom Update: Ofcom publishes its Market Impact Assessment of the BBC's proposed Gaelic Digital Service

Ofcom today published its Market Impact Assessment (MIA) of the BBC’s proposed Gaelic Digital Service (GDS) which includes a new digital channel to be co-funded by the BBC and Gaelic Media Service (GMS). Ofcom has concluded that the proposal will have a significant positive market impact, most notably for the Gaelic media sector.
 
Ofcom has submitted its conclusions to the BBC Trust to be taken into account alongside the Public Value Assessment (PVA).

Ofcom Update: Planned timetable for advertisement of DAB radio multiplex licences

Ofcom has today updated its planned timetable for the advertisement of new DAB (Digital Audio Broadcasting) radio multiplex licences. Two new licences have been added to the timetable, one to cover Somerset and the other to cover North Wales. The achievable coverage of the North Wales service may be significantly constrained until June 2015 (at the latest) under the terms of international spectrum agreements.

Ofcom Update: Ofcom publishes list of RSL applications for Ramadan 2008

Ofcom today published a list of applications received for radio restricted service licences (RSLs) during Ramadan 2008. Ofcom will no longer accept applications for RSLs in the areas named in the list, though there is still an opportunity to apply for an RSL for Ramadan in other areas.

 

Ofcom will assess these applications in early 2008. In areas where more than one application has been received, Ofcom will hold a draw to decide the winning applicant. Applicants in these areas will be contacted by Ofcom prior to the draws taking place.

Ofcom Update: Ofcom appoints new Competition Partner

Ofcom today announced the appointment of Stuart McIntosh as its new Competition Partner.

 

Mr McIntosh has been a leading Strategy Partner in the Communications practice at IBM in the USA for the past two years.  After graduation from the LSE, Stuart joined the UK Government Economic Service, followed by two spells with management consultants Coopers & Lybrand/PWC – where he led PwC’s Telecoms Consulting Practice - separated by four years at BT as Head of Business Economics. After four years at boutique consultancy Adventis, Stuart joined IBM Europe in 2003, transferring in 2005 to New York.

 

Stuart McIntosh said “Ofcom has very important duties in overseeing competition in the UK communications market. I look forward to leading this work and joining its impressive expert team.”   

 

Ofcom Chief Executive Ed Richards said “Stuart has a superb record of industry experience and leadership in the communications sector, so I am delighted we have been able to recruit someone of his calibre. I very much look forward to working with him.” 

 

Mr McIntosh will take up the post on 28 January 2008.
