Ofcom Update: Ofcom fines GMTV £2million for misconduct in viewer competitions

Ofcom has today fined GMTV £2,000,000 for misconduct in viewer competitions between August 2003 and February 2007. This is the largest financial penalty to be imposed against a broadcaster by Ofcom.
 
GMTV was found in breach of the following rules:
  • Rule 2.11 of the Ofcom Broadcasting Code, which came into effect on 25 July 2005,  "Competitions should be conducted fairly…"; and
  • Rule 8.2(b) of the ITC (Independent Television Commission) Code 2002 "Use of Premium Rate Telephone Services in Programmes: The licensee must retain control of and responsibility for the service arrangements....".
In particular, Ofcom's investigation found the following types of misconduct in GMTV competitions:
  • Early selection - picking competition finalists before lines had closed. This meant that substantial numbers of viewers who entered the competition stood no chance of being entered into the competition;
  • 15/5 method - selecting 15 competition finalists between 06.00 - 08.30 and the remaining five at 09.00 after the lines had closed. Viewers calling between 08.30 - 09.00 therefore had significantly less chance of being selected as a finalist than those who entered before 08.30; and
  • Final Five - selecting the final five competition finalists before the lines had closed.
Ofcom has also directed GMTV to broadcast a summary of Ofcom's finding on three separate occasions.

This is one of a number of current Ofcom investigations into individual programmes in the area of Participation TV. These are being dealt with on a case-by-case basis, Ofcom will be concluding these investigations over the next few months.

Ofcom Update: Review of Rules on the Amount and Distribution of Advertising

Ofcom today announced a review of rules governing the amount and scheduling of television advertising. The Review, which follows planned changes to European legislation allowing a more liberal approach to advertising regulation across Europe, will look both at the the frequency and volume of advertising on British commercial television.
 
Ofcom aims to reach decisions on advertising scheduling in time to allow any changes to come into effect on or before 1 January 2009. As regards the rules on the amount of advertising, Ofcom intends to conclude this process in time to allow any changes to be implemented from 1 January 2010.

Ofcom Update: Public Value Test into proposed Gaelic Digital Service - statement from the BBC Trust and Ofcom

The Public Value Test Joint Steering Group, comprising representatives of the BBC Trust and Ofcom, has decided to extend the Market Impact Assessment (MIA) into the proposal by the BBC and the Gaelic Media Service for a Gaelic Digital Service following a request from Ofcom.

Ofcom had proposed to complete the MIA in less than the standard three month timeframe.  However, a range of issues were raised by stakeholders that require further investigation and clarification. The MIA will still be submitted to the Trust by Ofcom within the standard three month period allowed for in the BBC’s Charter and Agreement. The BBC Trust will also use the time to consider further the level of public value offered by the proposal.

As a result of the extended MIA, the overall Public Value Test (PVT) timetable is likely to change. Subject to ratification by the Trust a revised timetable will be published.

The PVT will still be completed within the six months stipulated by the Charter and Agreement.

Ofcom Update: Ofcom says BBC's High Definition channel unlikely to have significant negative market impacts

Ofcom today published its Market Impact Assessment (MIA) which examines the BBC’s plans to introduce a new High Definition channel.
 
It finds that the BBC's plans to introduce a new mixed genre digital TV channel in High Definition format is unlikely to have significant negative market impacts.  It is likely to deliver consumer benefit through increased take-up of HD which is likely to spread across all the major TV platforms including digital terrestrial television, satellite and cable.  However, the MIA made a few recommendations relating to certain aspects of the channel.

 

Ofcom has submitted its conclusions to the BBC Trust to be taken into account alongside the Public Value Assessment (PVA).

Ofcom Update: Digital terrestrial television transmissions - technical update

Ofcom has today published an updated version of its 'Reference Parameters for Digital Terrestrial Television Transmissions in the United Kingdom'. The document sets out the basic technical characteristics which should be used by the UK's digital terrestrial broadcasters.
 
The parameters have been revised to permit the use of the 8K DVB-T transmission mode at specified transmitter sites, with prior Ofcom approval. This change will help facilitate digital switchover at those transmitter sites where, for technical reasons, 8K mode will need to be adopted.

Ofcom Update: Ofcom begins public service television broadcasting review

Ofcom today published the terms of reference for its second review of public service television broadcasting (PSB). The review will examine the extent to which the public purposes of PSB are being met and assess options for maintaining and strengthening the quality of PSB in future. It is expected to conclude in early 2009.  

 

Ofcom is keen that the PSB review draws upon views from all interested parties. To that end, Ofcom welcomes comments on the terms of reference and scope of the Review. It is published today at http://www.ofcom.org.uk/tv/psb_review/psb_2review/ and the deadline for responses is 30 September 2007.

 

Ofcom also intends to hold seminars during the first phase of the review to gather further views from stakeholders.

Ofcom Update: Ofcom updates its Broadcasting Code

Ofcom has today updated Section Nine of its Broadcasting Code in light of the Gambling Act 2005 coming into effect on 1 September 2007. The amendments ensure that the sponsorship rules set out in the Code are in line with the new Broadcast Committee of Advertising Practice (BCAP) rules for gambling advertisements on television and radio.
 
Ofcom will also be updating guidance to accompany Section Nine of its Code shortly. The updated version of the Broadcasting Code can be found on the Ofcom website at:
