Ofcom Update: Ofcom fines Islam Channel for Broadcasting Code breaches

Ofcom has today fined Islam Channel Ltd £30,000 for breaches of the Ofcom Broadcasting Code.

 

Islam Channel Ltd was fined for allowing candidates standing in UK elections to act as presenters on some of its programmes during an election period and for failing to comply with due impartiality requirements.

 

Specifically, Ofcom has found Islam Channel Ltd in breach of the following:

 

-        Section Five: Due Impartiality and Due Accuracy and Undue Prominence of Views and Opinions (specifically: rules 5.5 and 5.12);

 

-        Section Six: Elections and Referendums (specifically: rules 6.6, 6.8 and 6.9) and;

 

-        Licence Condition 11, for failing to supply a copy of a recording for examination.

Ofcom Update: Ofcom publishes consultation on future regulation of participation television

Ofcom today published its consultation on future regulation of participation television. Participation television is programming which invites viewers to interact, most often by using premium rate telephone services (PRS).

 

Ofcom is seeking views on the following proposals to strengthen viewer and consumer protection:

 

* New licence obligations for television and radio broadcasters which will hold broadcasters directly responsible for consumer protection and PRS compliance.

 

* A requirement for television and radio broadcasters to ensure independent third party verification of PRS activity.

 

In addition, Ofcom is also seeking views on the future regulation of dedicated participation TV services, which rely heavily upon interaction with viewers by means of PRS. The consultation sets out proposals to ensure that advertising and editorial content are kept separate, as required by European broadcasting legislation

 

The closing date for responses is 17 October 2007.

Ofcom Update: Planned timetable for advertisement of DAB radio multiplex licences

Ofcom has today updated its planned timetable for the advertisement of new DAB (Digital Audio Broadcasting) radio multiplex licences.  The planned dates of advertisement of the licences for each of Mid & West Wales and Surrey & northern Sussex have been postponed by two months.  This is to allow sufficient time for the development of international frequency co-ordination checking software to be completed by the International Telecommunications Union.  Further local radio multiplex licences will be added to the timetable later this year.

Ofcom Update: Ofcom publishes inquiry into use of PRS in television programmes

Ofcom has today published the outcome of the inquiry into the use of premium rate telephone numbers (PRS) in television programmes.

 

The inquiry, led by Richard Ayre, was launched by Ofcom in March 2007 following the high volume of investigations into programmes using PRS. These raised serious concerns for Ofcom about the scale of compliance failure in this area, and the impact on trust between broadcasters and viewers.

This paper summarises the findings of an audit commissioned by Ofcom on the available literature on ease of use (or usability) issues with domestic electronic communications equipment. The report summarises key usability issues that have been identified for a particular communications platform or service, highlights research or development work that had been undertaken to address these issues and identifies gaps where issues are not being addressed.
 
Following a period of engagement with stakeholders and debate on the issues raised in this report, Ofcom will put forward proposals for future work on usability as part of its annual planning process towards the end of 2007.

Ofcom Update: Ofcom publishes proposals for broadcasting sanctions procedures and an addendum to its New News, Future News discussion document

Ofcom today published a consultation on proposed improvements to its procedures for imposing sanctions in broadcast cases.  This forms part of Ofcom’s regular work to review key procedures (as set out in Ofcom’s Annual Plan).
 
Ofcom is seeking views on three key proposals to ensure that cases are dealt with more efficiently:
  • Introducing a fast-track procedure for sanctions in certain clearly defined cases e.g. if there is a risk of material harm, including financial loss to viewers or listeners, or where Ofcom considers it necessary in the public interest; 
  • Setting out guidelines on procedures for issuing a direction under a broadcasting licence and the revocation procedure in the Outline Procedure for sanctions in cases relating to broadcasting;
  • Streamlining the process for drafting sanctions papers whilst maintaining broadcasters’ opportunities to comment at all key stages of the procedure.
The deadline for responses is 6 September 2007.

Ofcom Update: Ofcom fines BBC for Blue Peter breaches

Ofcom has today fined the BBC a total of £50,000 for breaches of its Broadcasting Code in the 'live' transmission of Blue Peter on BBC1 on 27 November 2006 and the repeated edition on CBBC. This is the first occasion that Ofcom has imposed a financial penalty against the BBC.
 
The BBC was fined £45,000 for using a studio guest to pose as the winner of a viewer telephone competition in the 'live' broadcast of Blue Peter on BBC1. The broadcaster was found in breach of the following rules in the Broadcasting Code:
 
Rule 2.11 - "Competitions should be conducted fairly......"; and
 
Rule 1.26 - "Due care must be taken over the physical and emotional welfare and the dignity of people under eighteen who take part or are otherwise involved in programmes...."
 
The programme was then repeated in full, including the falsified competition, on CBBC. Although a caption was displayed stating that competition lines were closed, the telephone number was still visible and the lines were still open. This also resulted in a further breach of Rule 2.11 of the Code.  The BBC was fined £5,000 for this breach.

This is one of a number of current Ofcom investigations into individual programmes in the area of Call TV. These are being dealt with on a case-by-case basis and several of them will be concluded over the summer.
 
Separately, the inquiry led by Richard Ayre into the use of premium rate telephone services in television programmes, is ongoing. The findings of the inquiry will also be published this summer.
